Why Cottage Transactions Need Specialised Legal Attention
Many recreational properties in Ontario come with complexities that a general real estate lawyer may not encounter regularly:
- Crown land patents and road allowances. Some properties were originally granted by the Crown under patents with specific conditions. Others are accessed via unassumed road allowances.
- Water access and shore road allowances. Many waterfront properties are separated from the water by a 66-foot shore road allowance originally reserved by the Crown.
- Septic systems and environmental compliance. Non-compliant systems can create liability for new owners.
- Shared driveways, docks, and private roads. Legal arrangements governing shared amenities need careful review before purchase.
- Zoning and building restrictions. Cottage country zoning rules differ significantly from urban zoning.
